Terms of Use
Last updated: 15 October 2026
These terms govern the use of the ConnectSender website and panel. Where an organisation using the panel has also signed a written contract or offer with us, that document takes precedence over these terms.
1. The parties
The service is provided by İkipixel Bilgi Teknolojileri Tic. A.Ş. (Workinton, Emniyet Evleri Mh., Eski Büyükdere Cd., Sapphire AVM No: 1 Kat: B04, 34415 4. Levent / Istanbul, Türkiye) for customers established in Turkey, and by Ikipixel LLC (Boca Raton, FL, USA) for all other customers ("ConnectSender", "we"). The organisation using the service is the "customer"; the people who sign in to the panel for it are "users". The service is meant for businesses.
2. The service
ConnectSender is a panel for managing contact lists, Turkish and English email campaigns, templates and reports. Campaign emails are sent through the sending account the customer connects (Amazon SES, Mailgun, SendGrid, Purelymail or SMTP), not by ConnectSender itself.
3. Accounts and users
- Customer accounts are opened by ConnectSender. Users are added by invitation from the customer's authorised people.
- The customer is responsible for what its users do and for keeping access to its account secure.
- Tell us at once if you notice any unauthorised use.
4. The sending account
The terms, limits and fees of the sending service are between the customer and that service. Whether the service restricts or suspends an account, and whether an email reaches the inbox rather than spam, are outside ConnectSender's control.
5. Credits and payment
- Each email sent uses 1 credit. Credits are added in prepaid packages; packages and prices are set in an offer or contract.
- When a campaign starts, credits for all recipients are reserved; credits for emails that could not be sent go back to the account.
- Unless an offer or contract says otherwise, unused credits are not exchanged for cash or refunded.
- The sending service's fees are paid separately, directly to that service.
6. Acceptable use
The customer agrees to use ConnectSender only lawfully. In particular:
- Emails go only to people who agreed to receive them or who may lawfully be emailed. Compliance with the laws that apply to the recipients (for example the GDPR, ePrivacy rules, CAN-SPAM, and in Turkey Law No. 6563 and the Message Management System, İYS) is the customer's responsibility.
- No bought, rented or scraped lists.
- The unsubscribe link is not removed or disabled, and people who unsubscribe are not emailed again.
- No misleading, fraudulent, phishing, malicious, unlawful or offensive content.
- No attempts to get around or break the system's security, limits or records.
If these rules are broken, or complaint and bounce rates are high, we may suspend the account without prior notice.
7. Customer data and data processing
- For the recipient data a customer uploads, the customer is the controller and ConnectSender the processor. We process it only to provide the service and on the customer's instructions.
- Our staff with access to the data are bound by confidentiality.
- The sub-processors we use are Cloudflare (hosting, database, storage) and Resend (system emails). We tell customers before adding a new one.
- We take appropriate technical and organisational security measures, and we tell the customer without undue delay when we learn of a personal data breach affecting their data.
- We reasonably help the customer answer requests from its recipients.
- When the contract ends, customer data is returned or deleted as the customer asks, subject to legal retention duties.
- A detailed data processing agreement (DPA) can be signed with customers who ask for one.
Details on personal data are in the Privacy Policy.
8. Intellectual property
The panel, software, design and the ConnectSender brand are ours. Content the customer uploads (lists, templates, images, text) is the customer's; the customer lets us process it to provide the service and confirms it has the right to use it.
9. Availability
We make reasonable efforts to keep the service running without interruption or errors, but it is provided "as is". There may be interruptions for maintenance, updates or because of infrastructure providers.
10. Limitation of liability
To the extent the law allows, we are not liable for indirect damages or for loss of profit or data. Our total liability is limited to the amount the customer paid us in the 12 months before the event that caused the damage. Intent, gross negligence and liabilities that cannot be limited by law are not subject to this limit.
11. Suspension and termination
The customer may stop using the service at any time. We may suspend or close an account for a serious breach of these terms, non-payment or a legal requirement.
12. Changes
We update these terms when needed. We tell customers about significant changes before they take effect; continuing to use the service afterwards means accepting the updated terms.
13. Governing law and courts
- With İkipixel Bilgi Teknolojileri Tic. A.Ş.: Turkish law applies; the courts and enforcement offices of Istanbul (Çağlayan) have jurisdiction.
- With Ikipixel LLC: the laws of the State of Florida and applicable US federal law apply; the courts of Palm Beach County, Florida have jurisdiction.
